2. Service availability
Our site is only intended for use by people resident in the United Kingdom We do not accept orders from individuals outside those countries. Some restrictions are placed on the extent to which we accept orders from specific countries.
3. Your status
By placing an order through our site, you warrant that:
(a) You are legally capable of entering into binding contracts;
(b) You are at least 18 years old.
(c) Please note random temperature checks will be in place for the systems of coronavirus
Symptoms of coronavirus The most common symptoms are new:
fever/high temperature (37.8C or greater)
loss of, or change in, sense of smell or taste (anosmia)
A new continuous cough is where you:
have a new cough that’s lasted for an hourhave had 3 or more episodes of coughing in 24 hoursare coughing more than usual
A high temperature is feeling hot to the touch on your chest or back (you don’t need to measure your temperature).
You may feel warm, cold or shivery.
Some people will have more serious symptoms, including pneumonia or difficulty breathing, which might require admission to hospital.
4. How the contract is formed between you and us
4.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy Tickets. All orders are subject to acceptance by us following acceptance by the third party supplier.
4.2 We store the contract's content and will send you the details of your order as well as our general terms via e-mail. You can find the terms here at all times. The details about your recent orders can be found in your customer login.
5. Our Status
5.1 Please note that in most cases, we accept orders as agents on behalf of third party event organiser. The resulting legal contract is between you and that event organiser, and is subject to the terms and conditions of that third party supplier, which they will advise you of directly. You should carefully review their terms and conditions applying to the transaction These terms and conditions will govern any decisions on cancellation, exchanges and refunds. The third party supplier may enforce these terms and conditions in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999.
5.2 We may provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that Tickets you purchase from third party supplier through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party supplier. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party supplier.
6. Your obligations
6.1 You represent and warrant that the Tickets are purchased for personal use only, and that they have not been purchased as part of any form of business or commercial activity and in particular, that the Tickets may not be resold or offered for resale by anyone whether at a premium or for any other trade purposes. Resale or the attempted resale of the Tickets is grounds for seizure or cancellation of the ticket without refund or compensation.
6.2 It is your responsibility:
(a) for checking your ticket details, mistakes cannot always be rectified;
(b) for any loss, theft or damage to your Tickets after dispatch;
(c) to ascertain whether an event, performance or activity has been cancelled and the date and/or time rearranged. If the event, performance or activity is cancelled you will be offered Tickets for the rescheduled time and date. We will use reasonable endeavours to inform you of any cancellation once we have received notification of the same from the third party supplier;
(d) to arrive at the event on time. Every effort will be made to admit latecomers but admission cannot always be guaranteed.
(e) to comply with all relevant statues, venue regulations including age restrictions and safety announcements whilst attending the event, performance or activity.
6.3 The venue and/or third party supplier reserves the right to refuse admission if in its reasonable opinion, your admission to the venue might be a risk to:
(a) the safety of the audience and/or yourself;
(b) affect the enjoyment of the member of the audience; and/or
(c) affect the running of the event, performance or activity for example if you act aggressively and/or appear to be under the influence of alcohol and/or drugs.
Should this occur you will not be entitled to a refund.
6.4 Unauthorised use of photographic and recording equipment at any of the events, performances or activities is prohibited and any tapes or films may be destroyed.
6.5 Laser pens, mobile phones, dogs (expect guide dogs) and your own food and drink may also be prohibited.
6.6 We, The venue, third party supplier have no responsibility for any personal property.
6.7 You will consent to the filming and/or sound recording of any event, performance or activity as a member of the audience.
7. Availability and Delivery
7.1 For posted tickets, your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within a reasonable time of the date of the Dispatch Confirmation, unless there are exceptional circumstances.
7.2 We will endeavour to post Tickets with plenty of time for their arrival prior to the event. However it is your responsibility to order Tickets in plenty of time to allow for delivery , especially if you are travelling to an event.
7.3 If it become impractical for us to post Tickets, due to the proximity of the event, performance of activity or in circumstances beyond our control, we reserve the right to make the Tickets available for collection at the venue immediately prior to the event, performance or activity. You will be notified if this is necessary.
7.4 Tickets may be restricted to a maximum number per person, per credit card and for some events per household. We reserve the right to cancel tickets without prior notice purchased in excess of this number.
7.5 eTickets are made available for most events, and require no delivery. To redeem these tickets you need to attend the event, provide the event promoter with your name and show your payment debit/credit card as proof of ID
7.6 When purchasing eTickets, all customers on one order should arrive together. If purchasing for a large group who may arrive at different times you should purchase tickets seperately.
8. Risk and Title
8.2 eTickets will be at your risk from the time of order confirmation
8.3 Ownership of the Tickets will only pass to you when we receive full payment of all sums due in respect of the Tickets, including delivery charges where applicable.
9. Price and Payment
9.1 The price of any Tickets will be as quoted on our website from time to time, except in cases of obvious error. We sell Tickets on behalf of promoters, bands and venues which means that We do not set the Ticket prices.
9.2 These prices include VAT but exclude delivery costs, booking fees and other administration costs, which may be added to the total amount due as shown in your shopping basket.
9.3 We may charge a Booking Fee per ticket, which covers the costs Skiddle incur to process the transaction (including, but not limited to, card processing fees, VAT and other taxes, customer services and the provision of our services, including profit)
9.4 We may charge a Delivery/Handling Fee per order, which covers the costs Skiddle incur to make the ticket available to you and the event promoter (including, but not limited to, postage, hardware provision, software provision, including profit)
9.5 Prices are liable to change at any time, but changes will not affect orders in respect of which have already been placed.
9.6 Our website contains a large number of Tickets and it is always possible that, despite our best efforts, some of the Tickets listed on our website may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Ticket 's correct price is less than our stated price, we will charge the lower amount when dispatching the Ticket to you. If a Tickets correct price is higher than the price stated on our website, we will normally, at our discretion, either contact you for instructions before dispatching the Ticket , or reject your order and notify you of such rejection.
9.7 We are under no obligation to provide the Ticket to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing.
9.8 Payment for all Ticket s must be by credit or debit card.
9.9 We reserve the right to cancel tickets if the venue requires us to reduce an allocation or if we have oversold an event due to human error. In this case we will provide you with a full refund.
10. Refunds and Exchanges
10.1 We regret that tickets cannot be exchanged or refunded after purchase unless the event is cancelled.
10.2 If an event is cancelled, ticket holders will be offered tickets at any rescheduled event (subject to availability) up to the face value of the tickets or, if the ticket holder is unable to attend the rescheduled event or the event is not rescheduled, a refund of the face value of the tickets.
10.3 The promoter reserves the right to alter or vary the programme of an event without being obliged to refund or exchange tickets
10.4 Refunds for cancelled events (without a rescheduled date) will be processed automatically, you do not need to contact us to request.
10.5 Refunds for rescheduled events, whereby you cannot attend the rescheduled date, will be offered via an automated email. You must follow the link within the email to request your refund within 7 days of the cancellation email being sent, or before the rescheduled event takes place (whichever is sooner). If you are aware of a rescheduled event, but do not receive an email, please contact us immediately.
10.6 We cannot accept any refund requests outside of the periods stated above
10.7 Other fees such as Booking Fees, Handling/Postage fees, Charity Donations and Ticket Refund Protection are non-refundable.
10.8 Refunds will be issued only to the original purchaser or to the original credit card used for the purchase
11. Our liability
11.1 Our liability for losses you suffer as a result of us breaking this contract is strictly limited to the purchase price of the Ticket you purchased.
11.2 This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
11.3 Events, performances and activities may be cancelled by the third party supplier for a variety of reasons. In this event we will not be responsible for any cancellations or postponements.
11.4 Where you buy any Ticket from a third party supplier through our website, the suppliers individual liability will be set out in the supplier's terms and conditions which should be available from their website, or upon request.
12. Import Duty
12.1 If you order Tickets from our website for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
12.2 Please also note that you must comply with all applicable laws and regulations of the country for which the Tickets are destined. We will not be liable for any breach by you of any such laws.
13. Written Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
15. Transfer of rights and obligations
15.1 The contract between you and us is binding on you and us and on our respective successors and assigns.
15.2 You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
15.3 We may transfer, assign, charge, subcontract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
16. Events outside our control
16.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
16.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action.
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(e) Impossibility of the use of public or private telecommunications networks.
(f) The acts, decrees, legislation, regulations or restrictions of any government.
16.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
17.1 If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
17.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.
17.3 No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 14
If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
19. Entire Agreement
19.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
19.2 We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
19.3 Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other partyï¿œs only remedy shall be for breach of contract as provided in these terms and conditions.
We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
20. our right to vary these terms and conditions
20.1 We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
20.2 You will be subject to the policies and terms and conditions in force at the time that you order Tickets from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Tickets).
21. law and jurisdiction
Contracts for the purchase of Tickets through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
22. complaints and dispute resolution
22.1 If you have a complaint regarding a sale placed through our site that you feel is not being resolved to your satisfaction you have a few options.
22.2 a) Please ensure you have opened a support ticket with us Create new ticket, so your complaint is in writing, then ask for your complaint to be escalated to the Customer Care Manager.
23. WELFARE & COVID-19
Covid–19, often referred to as coronavirus, is an infectious disease that can result in serious and potentially fatal illness. There is a risk of the transmission of Covid–19 in any environment where people come together. This risk increases in enclosed spaces and with increased numbers of people. The World Health Organisation (WHO) has advised that the elderly and those with underlying medical conditions are more vulnerable. Further information can be found on the WHO’s website: https://www.who.int/health-topics/coronavirus#tab=tab_1.
Whilst The Estate Festival will be adopting enhanced safety measures to help attendees stay safe, the risk cannot be completely eliminated. Upon attending an Event, you assume all risk associated with Covid-19 (unless in any way caused by the negligence of The Estate Festival). You will also be expected to:
abide by all government guidance aimed at preventing the transmission of the virus (details of which can be accessed via the following link https://www.gov.uk/coronavirus and https://www.gov.scot/coronavirus-covid-19/ for shows taking place in Scotland); and
follow all directions provided by The Estate Festival and its Event staff and security stewards members.
You must not attend an Event if you believe that you may have been infected by Covid-19.
Failure to comply with these measures shall entitle The Estate Festival to eject you from the Event.
All Events are all subject to the latest Government guidance rules to manage the transmission of Covid-19. All customers are expected to adhere to the guidance and follow the code of conduct which will be in the pre-event information pack sent 3-7 days before the Event.
The following individuals MUST NOT ATTEND the Event;
Any individual displaying the symptoms of Covid-19 (new persistent cough, high temperature, loss of taste or smell).
Any individual who is self-isolating either due to displaying symptoms as above for 7 days, or any member of their household who is self-isolating for 14 days.
Any individual who has been instructed by the relevant contact tracing authority to isolate.
We ADVISE the following individuals NOT TO ATTEND the Event;
Any individual who has been informed that they are extremely clinically vulnerable and that they should be shielding.
Individuals who live in the same household as an individual who is extremely clinically vulnerable.
The refund policy set out below shall apply if GPPU is required to cancel any Event(s) due to any government guidance/restrictions.
24. Age Policy
All under 16s must be accompanied by an adult ticket holder (aged 18 or over) who must remain on site throughout the Event as the under 16-year-old’s guardian.
It is the responsibility of the supervisors of a child to determine whether an Event is suitable for that child to attend, and none of The Estate Festival, the ticket agent or venue accepts any liability or responsibility in relation to the same.
We do not accept any parental or supervisory duty of care or liability for any under 18s on site.
It is prohibited to resell tickets for the Event.
Personal arrangements including travel, subsistence and accommodation in relation to the Event which have been arranged by you are made at your own risk and neither the authorised ticket agent nor GPPU will have any liability for any such loss of enjoyment or wasted expenditure in addition to refunding the face value of the ticket.
Where the cancellation takes place part-way through an Event, you may only be entitled to a refund of part of the face price which you paid for the ticket.
It is your responsibility to check that the Event has not been cancelled, rescheduled or made the subject of a material alteration.
Tickets will not be refunded where they have been used to gain entry to the Event, or where you are able to and choose to attend a postponed Event.
Tickets are not transferrable and cannot be exchanged.
Tickets purchased from unauthorised sources may be rendered invalid and admission refused.
Tickets must be valid, presented in full, with stubs and not tampered with (in the event of accidental damage, refer to point of purchase prior to Event).
Tickets remain the property of GPPU until the Event closes.
GPPU will not issue duplicate tickets for lost or stolen tickets.
Tickets cannot be used as part of any marketing, media or sales promotion, without the prior written consent of GPPU.
Challage 25 if tickets purchased for 18+ event. A valid ID much be produced, we can deny access to event with no refund.
If you have obtained your ticket in breach of these T&Cs and/or if you breach any of these T&Cs then your ticket shall be void, and all rights conferred on you or evidenced by such ticket shall be void. If you seek to gain entry to the Event using a void ticket, then we reserve the right to refuse you entry to or evict you from the Event and you may be liable to legal action for trespass. Void tickets are non-refundable.
Refunds are only considered on major cancellation or material alteration.
For the purposes of these T&Cs: ‘major cancellation’ is the cancellation of the Event in full (and not rescheduled).; ‘material alteration’ is a change (other than a rescheduling) which, in The Est’s opinion, makes the Event materially different to the Event that ticket purchasers, taken generally, could reasonably expect. In particular, please note that the following are not deemed to be ‘material alterations’; changes to performance times; adverse weather conditions; changes to individual members of a band; curtailment of the Event where the majority of the Event is performed in full; and delays to starting the performance of an Event.
Refunds should be requested from the point of purchase, no later than 28 days after the Event.
A minimum of the proportionate amount of the face value of the ticket will be refunded.
Refunds of any booking fees per ticket and/or per order fees are subject to the T&Cs of the point of sale.
Refunds will only be made to the person who purchased the tickets.
You may be body/bag/car searched anywhere on site at any time by security and detection dogs. Searching is a condition of entry.
Any item(s), which may reasonably be considered to be a weapon (or used as a weapon), which may cause danger, offence or disruption to any other person, will be confiscated.
Any person carrying illegal items or carrying out illegal activity may be handed over to the Police, refused entry or evicted from the site without a refund.
Fires and the burning of any materials are not permitted anywhere on the Event site. Any such behaviour may lead to immediate eviction.
Excessive exposure to loud music may cause damage to your hearing.
Pyrotechnics, lasers, smoke machines, strobe lighting/special effects may take place during some performances.
All those attending the Event do so at their own risk.
The Estate Festival reserves the right to refuse you entry to and/or eject you from the Event. In particular but without limitation you may be refused admission to or removed from the Event for any of the following reasons: for health and safety or licensing reasons; if you behave in a manner which has or is likely to affect the enjoyment of other persons at the Event; if you use threatening, abusive or insulting words or mannerisms; if, in The Estate Festival’s reasonable opinion, you are acting under the influence of alcohol or drugs; if you fail, when required, to produce proof of identity or age; if you refuse to comply with The Estate Festivals’s security searches; if you breach these Terms; and/or if your ticket is void. No refunds will be given to you if you are refused entry or ejected from the Event due to your own behaviour.
28. Damage / Losses
GPPU will not be liable for any loss, injury or damage to any person (including yourself) or property however caused: (a) in any circumstances where there is no breach of a legal duty of care owed by GPPU, (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury as a result of a breach of a legal duty of care owed by GPPU); or (c) to the extent that any loss or damage results from breach by you of any of the T&Cs. Unless otherwise stated in this clause 51, GPPU’s total liability to you in connection with an Event (including, but not limited to, for any major cancellation, rescheduling or material alteration of an Event) shall be limited to a refund as set out in these T&Cs.
Nothing in these T&Cs seeks to exclude or limit any liability of GPPU for death or personal injury caused by its negligence, fraud or any other type of liability which cannot by law be excluded or limited.
We may prosecute you if you cause damage to the site, the site infrastructure, or cause harm to any other person at the Event and/or site.
29. Banned Items
Banned from Event – glass, fireworks/pyrotechnics, flares and distress flares, illegal items and substances, unidentifiable substances, new psychoactive substances (NPS), laser equipment/pens, air horns / megaphones, nitrous oxide and associated equipment (balloons / CO2 dispensers / cream dispensers), sky or ‘Chinese’ lanterns, sound systems, spray cans, unofficial tabards/high visibility reflective jackets, blow torches, individual camping gas canisters, firewood, aerosols over 250ml, petrol burners, any goods for unauthorised trading or with unauthorised Event or artist logos, any item that may reasonably be considered for use as a weapon, or which may cause danger, offence or disruption to any other person, unauthorised buses, coaches or trucks, drones
No animals, other than guide or hearing dogs, are permitted on site.
Banned from venue – firewood, flags, large or open drinks bottles (PERMITTED items include - under 500ml sealed* /water bottles). Bottles must be sealed and untampered or empty so that they are not used for bringing in alcohol to the arena. You cannot bring alcohol in to the arena (bars are available in the arena). If you have a medical condition that means you need to bring your own food or drink or medication, please bring a medical note or evidence to support this.
Under 18s are not permitted to bring or to purchase alcohol on site. A Challenge 25 policy will be in place for all alcohol sales on site. It is illegal for an over 18 to purchase alcohol on the behalf of under 18s.
Photographic and other recording equipment is permitted provided that it is for personal non-commercial use only. Unauthorised professional recording equipment is not permitted.
The use of drones or similar equipment for any reason is prohibited on or near the Event
Anyone resisting the confiscation of disallowed items or disregarding these conditions will face eviction.
Items that are surrendered or confiscated will not be returned.
